Please read these Terms and Conditions ("Terms") carefully before submitting your volunteer application. By checking the box and submitting this application, you ("you," "applicant") confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not submit the application.

1. About This Application

Jackson NJ Jewish Volunteer Ambulance Inc., doing business as Hatzulas Nefashos Emergency Medical Services ("Hatzulas Nefashos," "we," "us," or "our"), is a volunteer emergency medical services organization serving the South Jersey community. This application is the first step in being considered as a volunteer. Submitting it does not create any volunteer, employment, contractual, or agency relationship, and does not guarantee acceptance.

2. Accuracy and Completeness of Information

You certify that all information you provide in this application is true, accurate, and complete to the best of your knowledge. You understand that:

  • Providing false, misleading, or incomplete information is grounds for immediate rejection of your application or, if discovered later, termination of your volunteer status.
  • You are responsible for keeping your contact and eligibility information current and for promptly notifying us of any material change (including, but not limited to, a change in certification status, driver's license status, or criminal record).

3. Eligibility Requirements

You understand that to be considered, you must meet the eligibility criteria stated in the application, which may include being at least 18 years of age, being legally permitted to volunteer or work in the United States, and meeting any certification, licensing, or training requirements for the role. We may verify your eligibility at any time and may decline or discontinue your application if criteria are not met.

4. Background Check and Verification Consent

Because our volunteers serve vulnerable individuals during medical emergencies and may enter private homes, you consent to a background investigation as part of the application process. Specifically, you authorize Hatzulas Nefashos and its designated agents to:

  • Obtain and review a criminal history background check;
  • Verify your driving record, certifications, licenses, references, and prior experience;
  • Contact the references, employers, and organizations you have listed; and
  • Re-run any of the above checks periodically for as long as you remain a volunteer.

You release Hatzulas Nefashos, its officers, members, and agents, and any party providing information, from any liability arising from the good-faith gathering, use, or disclosure of this information for the purposes described here. A criminal record or adverse finding does not automatically disqualify you; it will be reviewed in light of the role and applicable law.

5. Volunteer (Unpaid) Status

You understand and agree that any volunteer position with Hatzulas Nefashos is unpaid and strictly voluntary. You will not receive wages, salary, benefits, or other compensation, and your service does not create an employment relationship. You are not entitled to workers' compensation or employment benefits except as may be specifically required by law. Nothing in this application or the volunteer relationship is a promise of paid employment.

6. No Guarantee of Acceptance

Submitting this application does not guarantee that you will be accepted as a volunteer. Acceptance is at the sole discretion of Hatzulas Nefashos and may depend on background check results, available positions, training capacity, certification, fitness for the role, and organizational needs. We may accept, decline, defer, or place conditions on any application without obligation to provide a reason.

7. Medical Fitness for Duty

EMS volunteer activities can be physically and emotionally demanding, including lifting, carrying, kneeling, working in adverse conditions, and exposure to distressing scenes. By applying, you represent that you believe yourself capable of performing the essential functions of the role you are seeking, with or without reasonable accommodation. We may require a medical clearance, fitness evaluation, or health screening before or during your service, consistent with applicable law.

8. Training, Certification, and Conduct Expectations

If accepted, you understand that you may be required to:

  • Complete and maintain required training, certifications (such as CPR, EMR, or EMT), and continuing education;
  • Participate in drills, orientations, and skill verifications;
  • Follow all Hatzulas Nefashos protocols, medical direction, policies, and the lawful instructions of supervising personnel;
  • Conduct yourself professionally, ethically, and respectfully toward patients, community members, and fellow responders; and
  • Comply with all applicable federal, state, and local laws and EMS regulations.

Failure to meet these expectations may result in suspension or termination of your volunteer status.

9. Confidentiality and Patient Privacy (HIPAA)

You understand that, as a volunteer, you may have access to confidential patient and organizational information protected by the Health Insurance Portability and Accountability Act (HIPAA) and other privacy laws. You agree to keep all such information strictly confidential, to use it only as needed to perform your volunteer duties, and not to disclose, photograph, record, or share it (including on social media) without proper authorization. This obligation continues even after your volunteer relationship ends.

10. Background Image, Likeness, and Communications

You agree that we may contact you by phone, text message, or email regarding your application and volunteer activities. If you become a volunteer, we may, where permitted, use photographs or recordings taken during organizational and community events; any separate media-release preferences will be addressed at that time.

11. Assumption of Risk and Release of Liability

You understand that emergency medical and rescue activities involve inherent risks, including exposure to communicable disease, hazardous conditions, physical injury, and emotional stress. To the fullest extent permitted by law, and in consideration of being considered for and (if accepted) participating as a volunteer, you assume these risks and release and hold harmless Hatzulas Nefashos, its officers, directors, members, volunteers, and agents from claims arising out of your application process and volunteer activities, except to the extent caused by gross negligence or willful misconduct. This Section does not waive any rights that cannot be waived under applicable law.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Hatzulas Nefashos and its officers, members, and agents from losses, claims, or liabilities arising out of your willful misconduct, gross negligence, violation of these Terms, or violation of law during the application process or your volunteer service.

13. At-Will Volunteer Relationship and Termination

Any volunteer relationship is entered into voluntarily and may be ended by you or by Hatzulas Nefashos at any time, with or without cause and with or without notice. We may suspend, restrict, or terminate your application or volunteer status at our discretion, including for conduct, safety, certification, background, or organizational reasons.

14. Data Privacy

The personal information you provide is collected and used to evaluate your application, conduct verification and background checks, communicate with you, and administer the volunteer program. We will handle your information consistent with applicable law and will not sell it. We may share it with service providers (such as background-check vendors) and as required by law. We retain application data as needed for our records and legal obligations.

15. Electronic Signature and Consent

By typing your name as a signature, checking the acceptance box, and submitting this application, you agree that:

  • Your typed name constitutes your legal electronic signature;
  • Your electronic signature has the same legal effect as a handwritten signature; and
  • You consent to conduct this application process electronically.

16. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the application process will be handled in the state or federal courts located in New Jersey.

17. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time you submit your application applies to that submission.

18. Acknowledgment

By checking the box below and submitting this application, you acknowledge that you have read and understood these Terms and Conditions, that the information you have provided is true and complete, that you consent to a background check and reference verification, that you understand the position is unpaid and acceptance is not guaranteed, and that you agree to all of the above.
